Land Transfer Tax Rebate on Resale Homes

Members will recall that the provincial government announced in December that the land transfer tax rebate previously offered to first-time buyers of newly-built homes would be extended to those first-time buyers who purchase a resale home as well. This program became effective the day it was introduced (December 13, 2007) and all eligible buyers who purchased a resale home on or after that date are entitled to receive this rebate. However, the legislative formalities of passing the amendment in the law have not yet happened, and will not until the government begins sitting once more. Therefore, qualified purchasers will not receive a cheque from the provincial government for the rebate until sometime after the amendment is passed by the legislature and receives royal assent. The Board will advise members when that process is complete. In the meantime, all eligible buyers should complete and submit the Ontario Land Transfer Tax Refund Affadavit for First-Time Purchasers of Eligible Homes (Resale) to the Ontario Ministry of Revenue.
